Who we are
This Privacy Policy explains how Byers & Co Marketing LLC, a Missouri limited liability company that operates under the name Byers & Co. Marketing (“Byers & Co.”, “we”, “us”), handles personal information connected with this website.
It covers:
- this website at bncmarketingstl.com, including any copy of it that our hosting provider serves at an address ending in byers-co-marketing.pages.dev;
- inquiries you send us through the website’s contact form or to the email address shown on this website, and our replies to them.
It does not cover other websites, including social media platforms where we have a profile, such as Instagram, which have their own policies. It also does not cover information we handle while delivering a client’s project, which the client’s signed agreement covers.
Questions or requests about this policy: [email protected].
Summary
- The contact form is the only place on this website where you can send us information. You can also email us directly.
- We use what you send to reply, discuss the project you ask about, prepare a proposal if you want one and keep a record of our conversation. We keep inquiries in Gmail and our Google files, and we may use AI assistants, such as ChatGPT and Claude, to help us manage inquiries and prepare replies.
- Asking for a quote never signs you up for marketing. Promotional messages need a separate sign-up.
- If an inquiry does not become a project, we delete our copies within six months after our last meaningful contact. Some providers keep their own copies on their own schedules, explained below.
- The site is hosted by Cloudflare, which also provides visit statistics. The site itself sets no cookies and uses no advertising or tracking pixels.
- We do not sell personal information, and we do not share it for targeted advertising.
Information we collect
Information you send us
When you use the contact form, it sends:
- your name and email address (required);
- your business name (optional);
- the service you are asking about (required, including “Not sure yet”);
- your project details (required);
- a fixed subject line, a routing key for our form service and an empty spam-trap field, which contain no information about you.
Like any request over the internet, sending the form also passes technical details to our form service, including your IP address, your browser and device type (user agent), the page you sent it from and the time.
If you email us directly, we receive whatever you include in your email, along with your email address and the details your email provider adds.
Please do not send passwords, payment card numbers, health information or other sensitive information through the form or by email.
Information collected automatically when you visit
Like almost every website, this site cannot be delivered without some technical information about each visit:
- Hosting and security. Our hosting provider, Cloudflare, processes each request to the site, including your IP address, browser and device type (user agent), the page requested, the referring page and the time. Cloudflare uses this to deliver the site, protect it from attacks and abuse, and give us aggregated traffic statistics.
- Visit statistics. Cloudflare Web Analytics runs on this site. When a page loads, a small script from Cloudflare reports the page address, the referring page, browser and device information, and how quickly the page loaded. Cloudflare states that this service does not use cookies or local storage and does not fingerprint individual visitors. We see only aggregated statistics, such as page views and load times.
- Network error reports. If your browser cannot load the site because of a network problem, it may send an error report to Cloudflare (Network Error Logging). Successful visits are not reported.
Cookies and similar technologies
This website does not set its own cookies and does not store anything in your browser’s local storage. Cloudflare may set strictly necessary security cookies (for example __cf_bm or cf_clearance) when its bot protection or security checks run on a visit. These help tell people from automated traffic; they are not used for advertising.
We do not use advertising cookies, social media pixels, tag managers or session recording on this website.
What we do not collect
This website has no accounts or logins, no payments, no chat, and no newsletter or text message sign-up. It does not ask for your phone number or address.
The sample websites under “Selected Work” (for fictional businesses) are demonstrations. Their forms, call buttons and other actions do not send anything to anyone.
How we use information
We use the information described above to:
- read and reply to your inquiry, and discuss the work you ask about;
- prepare a written proposal if you ask for one;
- organize inquiries, keep track of follow-ups and keep a record of our correspondence with you;
- keep the website running, secure and working well, and understand in general terms which pages are visited;
- meet legal obligations, and establish or defend legal claims.
Inquiries are not a marketing sign-up
Replying to your inquiry and discussing the project you asked about is separate from promotional messages, such as newsletters, promotional emails, text messages or unrelated campaigns. We send promotional messages only to people who sign up for them separately, through a choice they actively make. We never use a pre-checked box for this, and signing up is never a condition of sending an inquiry. This website does not currently offer any marketing sign-up.
AI tools
We may use AI assistants, such as ChatGPT (from OpenAI) and Claude (from Anthropic), to help us manage inquiries and prepare our replies, for example to summarize a request or draft a response. We may also connect an assistant to our business email account. Depending on the access we give it, a connected assistant may be able to read the messages in that account, including inquiries and our replies, not only a message we choose to share with it.
If we use these tools:
- each provider handles the information under its own terms and privacy policy and the settings of our account with it, and it may keep information for a period after we delete it, for example for safety or legal reasons;
- we use them with inquiry information only for the purposes described in this policy;
- before we use them in a way this section does not describe, we will update this policy.
How information is shared
We share information only as needed to run this website, answer your inquiry and run our business:
| Recipient | What they do for us | Information involved |
|---|---|---|
| Cloudflare, Inc. | Hosting, security, domain name service, visit statistics and network error reports | Technical visit information described above |
| Web3Forms (operated by Web3Creative) | Receives the contact form, emails it to us and keeps a copy (see “How long we keep information”) | Everything you enter in the form, plus the technical details sent with it |
| Web3Forms’ own providers | Infrastructure (Amazon Web Services, Cloudflare and Hetzner) and spam filtering (CleanTalk and Akismet) | Form submissions pass through the infrastructure providers; the spam filters receive your IP address and email address |
| Google LLC | Gmail, our business email, and Google Drive, Docs and Sheets, where we keep notes, including features built into those services | Your inquiry, the emails we exchange and any notes we keep about them |
| OpenAI and Anthropic | The AI assistants described above, if we use them | What we share with an assistant, and the messages it can read in our email account if we connect it |
| Subcontractors | Only if one helps us prepare a proposal or carry out work you ask about | What they need for that work |
Each provider handles information under its own terms and privacy policy.
We may also disclose information if the law requires it, to protect our rights or the safety of others, or as part of a sale or transfer of the business, in which case this policy would continue to apply to it.
We do not sell your personal information, and we do not share it for targeted (cross-context behavioral) advertising.
How long we keep information
- Inquiries that do not become a project. We delete our copies within six months after our last meaningful contact with you about the possible project, meaning a message or call between us about it. Automatic replies and spam do not count. This covers the copies we control: our email inbox, including deleted mail, notes in our files, conversations about your inquiry in any AI tool we use, exported copies and any other tool we use for inquiries.
- While we are still talking. If we are still in meaningful discussion about a project, we keep your inquiry, and the six months starts again from our latest meaningful contact.
- If you become a client. We keep project records for as long as we need them for the project and for our business, accounting, tax and legal obligations, as your client agreement describes where it covers this.
- Records we must keep. Contracts, invoices, records of a marketing sign-up or opt-out, records of privacy requests, and records needed for a legal obligation or an actual dispute are kept for as long as that obligation or dispute requires, even if we delete other information.
- Copies held by our providers. Some providers keep copies, logs and backups under their own retention schedules, which can run on different clocks from ours. For example, Web3Forms currently states that it keeps form submissions for up to three years from the date they are sent, unless they are deleted sooner. Its clock starts when you send the form, not at our last contact, so its copy can outlast ours. AI tools and email providers can also keep deleted information for a period under their own policies. If you would like a provider’s copy deleted, ask us and we will ask that provider to delete it, where it allows.
- Visit statistics and security logs: kept by Cloudflare under its own retention settings. We see aggregated statistics only.
How we protect information
Only one person, the owner of the business, has human access to our business inbox. The service providers named above, and apps we connect to our accounts, process messages as part of the services they provide to us.
The website is served only over encrypted connections (HTTPS), the contact form sends directly to our form service over HTTPS, and the site itself stores no visitor information.
No method of sending or storing information is completely secure, so we cannot guarantee absolute security. If a security incident affects your personal information, we will notify you where the law requires it.
Your choices and requests
You can choose not to use the contact form and email us instead, or not contact us at all. Browsing the site does not require you to give us any information.
You can ask us to:
- tell you what personal information we hold about you, and give you a copy;
- correct it;
- delete it;
- stop sending you promotional messages, if you have signed up for them.
How to ask. Email [email protected]. To protect your information, we may ask you to confirm that the request comes from you, usually by replying from the email address you used with us. We will ask only for what we need to confirm it.
When you will hear from us. We aim to confirm that we have received your request, and explain the next steps, within 3 to 5 business days. That is our target for acknowledging a request, not for completing it. We will complete your request without undue delay and within any time limit the law sets for it. If the law allows more time and we need it, or if we cannot do everything you ask (for example, because we must keep a record for a legal obligation or an actual dispute), we will tell you why.
Deletion. When we delete your information, we delete our copies and ask our providers to delete theirs where they allow it. Some copies in providers’ logs and backups are removed later, on their own schedules. We keep a short record of your request and how we handled it.
Some U.S. state privacy laws give residents specific rights. Many of those laws apply only to businesses above certain size or data-volume thresholds. We will honor the requests above for anyone who asks, wherever they live.
Do Not Track and Global Privacy Control
This website does not track visitors across other websites over time, and we do not allow third parties to do so through this site. Because of that, the site does not change its behavior when your browser sends a “Do Not Track” or Global Privacy Control signal: there is no cross-site tracking or sale of information for those signals to turn off.
Children’s privacy
This website is for businesses and adults looking for marketing and website services. It is not directed to children, and we do not knowingly collect personal information from children under 13. If you believe a child has sent us personal information, email us and we will delete it.
Visitors outside the United States
We are based in the United States, and this website is run from the United States. Information you send us is processed in the United States and wherever our providers operate. For example, Web3Forms operates from India and uses infrastructure providers in several regions.
Changes to this policy
If we change how we handle information, we will update this page and its dates. If a change is significant, we will say so clearly on this page before it takes effect.
